Vascular Solutions, Boston Scientific resolves catheter patent dispute-MassDevice

Vascular Solutions (NSDQ:VASC) said yesterday that it had reached a patent infringement dispute with Boston Scientific Corporation (NYSE:BSX) over their respective coronary artery-guided extension catheters, thereby quelling two lawsuits filed by each other.

Other terms of the transaction were not disclosed.

"As part of the settlement agreement, all lawsuits between the parties related to the extension of the guidelines will be dismissed. The terms of the settlement are confidential," Vascular Solutions said.

Vascular Solutions, based in Minneapolis, filed a lawsuit in May 2013, alleging that Boston Scientific’s Guidezilla catheter “is a replica of VSI’s GuideLiner catheter. The design, materials, and dimensions of Guidezilla are basically the same as those of GuideLiner. Same as in patent-litigation," according to court documents. Boston Scientific filed a counterclaim, accusing it of infringement of patents covering Guidezilla devices.

A year ago, Vascular Solutions asked Judge John Tunheim of the U.S. District Court of Minnesota to grant an injunction preventing its larger competitors from “manufacturing, using, offering for sale, or selling Boston Scientific’s Guidezilla guide extension catheters or any other guide extension catheters.” According to the documents, this is suspected of infringing the patent. Boston Scientific filed a sealed motion against the ban on bidding, but Tunheim approved the ban in December 2013. The U.S. Court of Appeals for the Federal Circuit rejected Boston Scientific’s request in January to suspend the enforcement of the injunction during the appeal period, but later ruled that there were too many unknowns to defend the injunction.

Boston Scientific launched Guidezilla catheters in the United States and Europe in July 2013.
